Terms and Conditions for SG3000

Order Acceptance: Stargate International, Inc. (Stargate) reserves the right to accept or reject any order. Orders received, acknowledged and accepted by Stargate are considered firm orders. Changes made by the buyer to the order may be subject to price adjustments.

Prices: Products are sold at prices in effect at time order is taken. Stargate reserves the right to change prices without notice when necessary. All prices are F.O.B. factory.

Taxes: Except in Colorado prices do not include taxes. Consequently, the amount of any present or future sales, use, excise or other similar tax applicable to the sale of the products shall be paid by the buyer unless a properly executed tax exemption certificate acceptable to the tax authorities is provided. In Colorado, Sales taxes will be added.

Delivery: Contact Stargate to obtain specific information regarding shipping time for any orders. If there is stock on hand, the SG3000 will usually ship within 3-5 workdays. If supplies have been exhausted, we require 8-10 weeks from date of order to complete. Please allow that much time for delivery unless other arrangements have been made.

Shipping: All products will be shipped UPS Ground unless other arrangements have been made. Stargate may work with the buyer to arrange shipping from Colorado to point of destination.

Damaged merchandise: Stargate cannot be held liable for damaged equipment or loss of a shipment by a freight carrier. Claims for damaged products, for suspected damages, or container shortages must be noted on the carrier’s delivery receipt. The carrier claims representative should then be notified immediately.

Final Sales: All sales are final. Should there be a problem with any SG3000 please return it to the factory for Warranty repair as explained in the paragraphs of this warranty.

Billing: For purchases of the SG3000 by a customer with approved credit, the billing will be net 30. Without approved credit the transaction must be cash in advance of shipment. For leases, all sales will be turned over to Marlin Leasing and will be governed by Marlin Leasing’s terms and conditions

Foreign shipments: All foreign shipments must be prepaid in United States currency, by certified funds or wire transfer, prior to shipment.

No endorsement of use: Stargate cannot assume responsibility for the way the product is used by the buyer. Stargate makes no warranty, expressed or implied that the product will provide acceptable results in any particular use other than the use described in the training material included with the SG3000.

Technical advice: Stargate believes that any technical advice furnished by it or its representatives is reliable. Notwithstanding that belief, Stargate makes no warranties, express or implied, of results to be obtained. Buyer assumes all responsibility for loss or damage resulting from the handling or use of any of Stargate's products, or from any such technical advice.

LIMITED WARRANTY – Unless otherwise warranted, Stargate warrants, to the original purchaser, its new products to be free from defects in workmanship and material for a period of one year from the date of purchase. The warranty for any parts used in assembling the products that are not manufactured by Stargate or its hires, is limited to the warranty actually extended to Stargate from its supplier. Further, Stargate warrants that the equipment will meet the requested specifications when properly installed under normal conditions of operation. Stargate assumes no responsibility for the suitability of the intended use of its products.

NOTE: The company will not be responsible for the damage or losses, direct or indirect, arising from any cause whatsoever, nor for damage to the equipment caused by outside influences including modifications, improper installation and maintenance, corrosion and/or electrolysis, improper voltage supply, lightning, or careless handling, nor for labor, transportation or other charges incurred in the replacement or repair of defective parts. There are no warranties, expressed or implied, applicable to products, except as stated herein. Stargate will not be responsible for any statements that are made or published, written or oral, which are misleading or inconsistent with the facts as published in the literature or specifications furnished by the company.
